Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the GoBe mobile application (the "App"), operated by Hamed Bakayoko, an individual sole trader (trading as "GoBe") based at 35 Cheshire Close, CR4 1XF, United Kingdom ("GoBe," "we," "us," or "our"). By creating an account or otherwise using the App, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the App.

2. Eligibility

You must be at least 16 years old to create a GoBe account or use the App. During sign-up you are required to enter your date of birth to confirm your age. By creating an account, you represent that you meet this minimum age and that the date of birth you provide is accurate. If we learn that an account belongs to someone under 16, we will close the account and delete the associated data.

3. Description of the Service

GoBe lets you record "Trails" — routes you travel, tracked via your device's location services — and create "Traces" — notes, optional photos, and pinned locations along your route — and view them on a map. You use GoBe signed in — with an Apple ID, or with an email-verified username and password. GoBe is a user-to-user service: content you share may be visible to other users where the App's features allow.

4. Your Account

You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. Notify us promptly at hamedibakayoko82@gmail.com if you suspect unauthorised use of your account. We may suspend or terminate accounts that violate these Terms.

5. Acceptable Use

When using GoBe, you agree not to:

• Post or include in any Trace, Trail, username, display name, or photo any content that is illegal, harassing, threatening, hateful, sexually explicit, or otherwise violates the rights of others;
• Impersonate any person or entity, or misrepresent your affiliation with one;
• Use the App to stalk, track, or harass another person without their consent, or to share another person's private information or precise location without their consent;
• Upload content you don't have the right to share, or that infringes someone else's intellectual property or privacy;
• Attempt to interfere with, disrupt, reverse-engineer, or gain unauthorised access to the App or its backend systems;
• Use the App for any unlawful purpose.

We may remove content or suspend or terminate accounts that we believe, in good faith, violate this section.

6. Content Moderation, Reporting & Illegal Content

We operate systems and processes to help keep GoBe safe and to detect and remove illegal content and content that breaches these Terms, in line with our duties under the Online Safety Act 2023.

You can report any Trace, Trail, profile, or user that you believe is illegal, harmful, or in breach of these Terms — use the in-app reporting tools, or email us at hamedibakayoko82@gmail.com. Tell us what the content is, where you found it, and why you are reporting it. We aim to review reports of serious harm without undue delay, and we will remove content we find to be illegal or in breach of these Terms.

If you believe content on GoBe infringes your intellectual property or privacy rights, contact us at the same address with enough detail to identify the content and your rights, and we will deal with it under our notice-and-takedown process. We may remove content, restrict features, or suspend or close accounts where we reasonably believe this is necessary to comply with the law or to protect users.

7. Your Content & Licence to GoBe

You retain ownership of the Traces, Trails, photos, and other content you create in GoBe ("Your Content"). By submitting Your Content, you grant Hamed Bakayoko a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display Your Content as necessary to operate and provide the App's features (for example, rendering your Trail on a map, or showing a Trace you've shared to other users where the feature allows it). This licence ends when you delete the content or your account, except for content other users have already saved or where we must retain it to comply with the law.

You are solely responsible for Your Content and for ensuring you have the rights to share it. As described in our Privacy Policy, photos you upload are stored privately and can only be accessed by signed-in users through an access-controlled endpoint.

8. Location Tracking & Your Safety

GoBe's core functionality depends on access to your device's precise location, including background location while you are actively recording a Trail. By using these features, you acknowledge and consent to this collection, understanding that the App may continue to use your location after you leave the App or lock your device. You can stop a recording or revoke location permissions in iOS Settings at any time, though doing so will limit or disable trail recording.

To help protect your privacy, GoBe stores Traces only at an approximate location (rounded to a coarse grid) rather than your exact coordinate, and lets you mark one or more "protected areas" — places such as your home, your workplace, or the gym, which you choose yourself on a map. Protected areas are kept on your device only and are never uploaded, and GoBe warns you before you post a Trace inside one. These protections reduce, but cannot eliminate, the risk of revealing where you are.

Your safety is your own responsibility. Be aware of your surroundings, traffic, and other hazards while moving — do not let the App distract you. Think carefully before sharing locations of sensitive places such as your home, a child's school, or anywhere you would not want to be publicly known. If you choose to meet, online or in person, people you encounter through GoBe, you do so at your own risk.

9. Disclaimers

GoBe is provided "as is" and "as available," without warranties of any kind except those that cannot be excluded by law. We do not warrant that the App will be uninterrupted or error-free, or that recorded routes, locations, or step counts will always be accurate — GPS, motion sensors, and network connectivity can all affect accuracy. We do not control and are not responsible for content posted by other users. This section does not affect your statutory rights as a consumer (see section 11).

10. Limitation of Liability

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for any other liability that cannot be excluded or limited under the laws of England and Wales, including your statutory rights as a consumer.

Subject to that paragraph, and to the fullest extent permitted by law: we provide GoBe to you free of charge and for your domestic and private use only; we are not liable for any loss that is not a reasonably foreseeable result of our breach, for any business losses, or for loss or damage caused by events outside our reasonable control; and we are not responsible for the content, conduct, or actions of other users, including any interactions or meetings you have with them online or in person. Where we are liable to you, our liability is limited to loss that was reasonably foreseeable by both you and us when you started using the App.

11. Your Consumer Rights

As a consumer, you have legal rights that these Terms do not affect. Where GoBe is supplied as a digital service, you have rights under the Consumer Rights Act 2015 — including that the service is provided with reasonable care and skill. Nothing in these Terms excludes or limits those rights. For more information about your rights, contact your local Citizens Advice service or Trading Standards office.

12. Termination

You may stop using the App and delete your account at any time using the "Delete Account" feature in the App's Account screen. We may suspend or terminate your access to the App if we reasonably believe you have violated these Terms, where necessary to comply with the law, or if we discontinue the App — and, where it is reasonable to do so, we will give you notice. Sections of these Terms that by their nature should survive termination — such as content licences already granted, disclaimers, and limitations of liability — will survive.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date above and, where appropriate, notify you in the App. Continuing to use GoBe after a change takes effect means you accept the updated Terms.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. You and we agree that the courts of England and Wales have jurisdiction over any dispute. If you are a consumer resident outside England and Wales, you keep the benefit of any mandatory consumer-protection rules of your country of residence, and you may be able to bring proceedings in your local courts where the law allows.
